Please read these Terms and Conditions carefully before using ApplyMantra. By accessing or using our platform, you agree to be bound by these terms.

1. About ApplyMantra & Petal Apps

ApplyMantra (applymantra.com) is an AI-powered career and job-application assistance platform developed and operated by the Petal Apps team (hereinafter referred to as "Petal Apps," "we," "us," or "our").

Petal Apps is a registered proprietorship firm under the laws of India. ApplyMantra is developed by the Petal Apps team and serves job seekers by aggregating job listings, providing AI-driven resume tailoring, application tracking, interview preparation, and related career-enhancement services.

2. Acceptance of Terms

By accessing, browsing, or registering on ApplyMantra, you ("User" or "you") agree to be legally bound by these Terms and Conditions, our Privacy Policy, Refund Policy, and Cancellation Policy, which are incorporated herein by reference.

If you do not agree to these Terms, you must immediately discontinue use of the platform. If you are accessing ApplyMantra on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

These Terms constitute a legally binding agreement between you and Petal Apps and are governed by the Information Technology Act, 2000 ("IT Act"), the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Indian Contract Act, 1872, and all other applicable Indian laws and regulations.

3. Services Offered

ApplyMantra provides the following services (collectively, the "Services"):

  • Job aggregation: Real-time search across 30+ job boards, curated and ranked by AI.
  • AI Resume Tailoring: Automated matching and editing of resumes to specific job descriptions.
  • Application Tracker: A centralised dashboard to track job applications and their status.
  • Interview Preparation: AI-generated practice questions and feedback.
  • Career Guides: Publicly available articles and resources on job searching.
  • Industry Pulse / News: Curated job-market news and insights.

We reserve the right to add, modify, suspend, or discontinue any Service (or part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of Services.

4. Eligibility & Account Registration

4.1 Eligibility

To use ApplyMantra, you must be at least 18 years of age and legally competent to enter into a binding contract under the Indian Contract Act, 1872. By using the platform, you represent and warrant that you meet these requirements.

4.2 Account Creation

You must create an account to access most features. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information to keep it accurate.
  • Keep your password confidential and not share it with any third party.
  • Notify us immediately at support@applymantra.com upon any unauthorised use of your account.
  • Accept responsibility for all activities that occur under your account.

4.3 Account Security

We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials. We may disable your account at our discretion if we believe security has been compromised.

5. Subscription Plans & Payments

5.1 Free & Paid Plans

ApplyMantra offers both free and paid subscription tiers. The features available under each tier are described on our pricing page and may be updated from time to time. Paid subscriptions ("Premium Plans") are billed on a recurring basis (monthly or annually, as selected at the time of purchase).

5.2 Payment Terms

  • All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.
  • Payments are processed through secure third-party payment gateways compliant with RBI guidelines and PCI-DSS standards.
  • By providing payment details, you authorise us to charge the applicable fees to your chosen payment method.
  • All transactions are subject to the terms of the payment gateway provider.
  • Applicable Goods and Services Tax (GST) will be charged as per prevailing Indian tax laws.

5.3 Auto-Renewal

Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You will receive an advance email notice prior to renewal. You may disable auto-renewal at any time from your account settings or by contacting our support team.

5.4 Price Changes

We reserve the right to modify subscription prices. Any price change will be communicated to you at least 30 days in advance via email and/or in-platform notification. Continued use of the platform after the price change takes effect constitutes your agreement to the new pricing.

5.5 Failed Payments

If a payment fails, your subscription may be downgraded to the free tier until payment is successfully processed. We will notify you of failed payments and provide a reasonable opportunity to update payment details.

6. User Conduct & Prohibited Activities

You agree to use ApplyMantra only for lawful purposes and in a manner consistent with all applicable Indian laws and regulations. The following activities are strictly prohibited:

  • Using the platform to submit false, misleading, or fraudulent information in job applications or on your profile.
  • Impersonating any person or entity, or falsely representing your affiliation with a person or entity.
  • Uploading, transmitting, or distributing any malware, viruses, or malicious code.
  • Attempting to gain unauthorised access to any part of the platform, servers, or databases.
  • Scraping, data-mining, crawling, or using automated tools to access the platform without our written consent.
  • Reverse engineering, decompiling, or disassembling any part of the platform.
  • Harassing, threatening, or abusing other users or platform staff.
  • Uploading content that is defamatory, obscene, discriminatory, or violates any applicable law.
  • Using the platform to send unsolicited commercial communications (spam).
  • Circumventing, disabling, or otherwise interfering with security-related features of the platform.
  • Using the platform for any purpose that violates the Information Technology Act, 2000 or any other applicable Indian law.

We reserve the right to investigate suspected violations and to terminate accounts, remove content, and/or report violations to law enforcement authorities without prior notice.

7. Intellectual Property

7.1 Our IP

The ApplyMantra platform, including but not limited to its software, source code, algorithms, UI/UX design, trade marks, logos, content, and all other materials (collectively, "Company IP"), are the exclusive property of Petal Apps and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform solely for personal, non-commercial job-search purposes, subject to these Terms. No other rights are granted.

7.2 Restrictions

You may not:

  • Copy, reproduce, modify, adapt, translate, or create derivative works based on Company IP.
  • Distribute, sell, sublicense, or transfer Company IP to any third party.
  • Remove or alter any copyright, trade mark, or other proprietary notices.
  • Use Company IP for any commercial purpose without our express written consent.

8. User-Generated Content & Data

8.1 Your Content

You retain ownership of all content you upload to ApplyMantra, including resumes, cover letters, profile information, and any other materials ("User Content").

By uploading User Content, you grant Petal Apps a limited, worldwide, royalty-free licence to use, store, process, and display your User Content solely for the purpose of providing you with the Services. We will not sell or share your resume or personal profile data with employers or third parties without your consent, except as described in our Privacy Policy.

8.2 Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

  • You own or have the necessary rights to the content you upload.
  • Your content does not infringe any third-party intellectual property rights.
  • Your content does not violate any applicable law or regulation.
  • Your content is accurate and not misleading.

9. Third-Party Services & Links

ApplyMantra may contain links to third-party websites, job boards, employer portals, and services. We do not control, endorse, or assume responsibility for any third-party content, privacy practices, or services. Accessing third-party links is at your own risk.

We use third-party service providers for payment processing, analytics, cloud infrastructure, and AI services. These providers are bound by their own privacy and security policies. We are not liable for any acts or omissions of third-party providers.

10. Disclaimers & Limitation of Liability

10.1 Disclaimer of Warranties

The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:

  • The platform will be uninterrupted, timely, secure, or error-free.
  • Any job listings on the platform are accurate, complete, or current.
  • The use of our AI tools will result in successful job applications or employment.
  • Any information obtained through the platform will meet your expectations.

10.2 Limitation of Liability

To the maximum extent permitted under applicable Indian law, Petal Apps, its proprietor, employees, agents, and team members shall not be liable for any:

  • Indirect, incidental, consequential, special, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or business opportunities.
  • Damages arising from your reliance on any information provided by the platform.
  • Damages arising from unauthorised access to your account or User Content.

Our total aggregate liability to you for any claims arising from these Terms or use of the platform shall not exceed the amount paid by you to us in the three (3) months immediately preceding the event giving rise to the claim, or ₹1,000, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Petal Apps and its proprietor, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the platform.
  • Your violation of these Terms.
  • Your violation of any applicable law or third-party rights.
  • Any User Content uploaded by you.

12. Termination & Suspension

12.1 By You

You may terminate your account at any time by contacting us at support@applymantra.com or through your account settings. Termination does not automatically entitle you to a refund; please refer to our Refund Policy.

12.2 By Us

We may suspend or terminate your account immediately, without prior notice, if we reasonably believe that you have violated these Terms, applicable law, or if continued access poses a risk to the platform or other users. We may also terminate the platform or any Service with reasonable advance notice.

12.3 Effect of Termination

Upon termination, your right to use the platform ceases immediately. We may delete your account data in accordance with our Privacy Policy and applicable law. Sections that by their nature should survive termination (including IP rights, disclaimers, indemnification, and governing law) shall continue to apply.

13. Governing Law & Dispute Resolution

13.1 Governing Law

These Terms and all disputes arising from or relating to them shall be governed exclusively by the laws of India, without regard to conflict of law principles.

13.2 Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the platform, the parties shall first attempt to resolve the matter amicably through good-faith negotiations. If the dispute is not resolved within 30 days of written notice, either party may refer the matter to arbitration.

13.3 Arbitration

Any unresolved dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator appointed by mutual agreement. The seat of arbitration shall be Thane, Maharashtra, India. The language of arbitration shall be English.

13.4 Jurisdiction

Subject to the arbitration clause above, the competent courts at Thane, Maharashtra (with the Bombay High Court at Mumbai as the appellate court) shall have exclusive jurisdiction to adjudicate any matters not subject to arbitration.

14. Grievance Officer

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection Act, 2019, we have designated a Grievance Officer to address user concerns.

Users may file complaints related to violations of these Terms, privacy breaches, or any other concerns with the Grievance Officer. We are committed to acknowledging grievances within 48 hours and resolving them within 30 days of receipt.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email notification and/or a prominent notice on the platform at least 15 days before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the revised Terms.

We encourage you to review these Terms periodically. The date of the most recent revision is displayed at the top of this page.
